We are the responsible party for the processing of personal information described in this policy, as that term is defined in the Protection of Personal Information Act 4 of 2013 (POPIA). We take our obligations under POPIA seriously and have written this policy so that you know exactly what we collect, why, and what you can do about it.
What personal information do we collect, and how?
We collect personal information through two channels on this site. The first is our contact form, which visitors use to ask about our financial consulting services. When you submit it, we receive your name, email address, phone number if you provide one, and the content of your message.
The second is our email subscription. If you choose to subscribe to updates from Farnesto, we collect your email address and, where you supply it, your name. We do not collect personal information passively beyond what is described in our separate Cookie Policy.
On what legal basis do we process your information?
We process contact-form submissions on the basis of your consent, given when you voluntarily complete and submit the form, and because doing so is necessary to take steps at your request before entering into a consulting engagement with you, as contemplated by POPIA's processing conditions.
We process email subscription data on the basis of your consent, obtained when you sign up. You may withdraw this consent at any time, as explained below, without affecting the lawfulness of processing carried out before withdrawal.
Do we use cookies?
Yes. Our use of cookies is governed by our separate Cookie Policy, which sets out the necessary, analytics, and marketing categories we use and how you can manage your preferences. We only place non-essential cookies once you have given consent through our cookie banner.
Who hosts and processes this data?
Our website and the data submitted through it are hosted with infrastructure providers who process personal information on our behalf under written agreements requiring them to apply appropriate security safeguards. Where any such provider is located outside South Africa, we ensure the transfer complies with the cross-border transfer conditions in section 72 of POPIA, including that the recipient is subject to laws or agreements providing an adequate level of protection.
We do not sell, rent, or otherwise trade your personal information to third parties for their own marketing purposes.
How long do we keep your information?
Contact-form enquiries are retained for as long as is reasonably necessary to respond to your query and for a limited period afterwards in case you follow up, typically no longer than twenty-four months, unless a longer period is required to establish, exercise, or defend a legal claim.
Email subscription details are kept for as long as you remain subscribed. If you unsubscribe, we retain a minimal record of your email address on a suppression list to ensure we do not contact you again, unless you ask us to delete this record entirely.
What rights do you have?
Under POPIA you have the right to be notified that your information is being collected, to access the personal information we hold about you, and to request correction, deletion, or destruction of personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, or obtained unlawfully.
You may also object to the processing of your personal information, withdraw any consent previously given, and lodge a complaint with the Information Regulator of South Africa if you believe we have processed your information unlawfully. How do you unsubscribe or update your details?
Every email we send includes an unsubscribe link that removes you from our mailing list immediately. If you wish to update, correct, or delete any information you have submitted through our contact form, simply email us at [email protected] and we will action your request within a reasonable time, generally within thirty days.
How do we keep your information secure?
We apply reasonable technical and organisational measures, appropriate to the nature of the personal information involved, to protect it against loss, unauthorised access, interference, modification, or disclosure, as required by section 19 of POPIA. Access to submitted data is limited to staff who genuinely need it to respond to you or manage our mailing list.
Should a security compromise occur that has compromised your personal information, we will notify the Information Regulator and you, as the data subject, as soon as reasonably possible, in accordance with section 22 of POPIA.
